TERMS OF SERVICE & END USER LICENSE AGREEMENT

Welcome to medicentsllc.com. These Terms of Service and End User License Agreement (“Agreement”) govern your access to and use of the 2027 Benefits Blueprint file and print-outs generated by the file (the "Product"). By purchasing, downloading, or using the Product, you agree to be bound by this agreement.

1. THE MERCHANT OF RECORD

All payments, tax compliance, and order fulfillments are processed by Polar Software, Inc. ("Polar"), acting as the Merchant of Record. By completing a purchase, you acknowledge and agree that your transaction is also governed by Polar’s Terms of Service. Polar is responsible for processing payments, collecting applicable taxes (VAT/Sales Tax), and delivering instant download links.

2. LICENSE GRANT, DURATION, & USAGE RIGHTS

Upon successful payment, Medicents LLC grants you a non-exclusive, non-transferable license to use the Product for the 2027 Plan Year. All licenses under this Agreement strictly expire on December 31, 2027. Use of the Product or generation of outputs for plan years after December 31, 2027, is strictly prohibited and constitutes a material breach of this Agreement.

A) SINGLE EMPLOYER LICENSE ($299): Grants one (1) business entity (single EIN) the right to use the Product to generate benefit summaries and guides for its own internal employees.

B) BROKER & AGENCY LICENSES ($1,195+): Grants an insurance brokerage or benefits consulting agency the right to use the Product to generate materials for up to the specific client tier purchased:

• Tier 1 (Up to 5 clients): $1,195

• Tier 2 (Up to 15 clients): $2,685

• Tier 3 (Up to 40 clients): $5,160

• Tier 4 (41 or more clients): $7,900 per plan year

C) MODEL CAPACITY & SPECIFICATIONS: The Product is created to manage a maximum of four (4) health plan options simultaneously per generated report. Medicents LLC makes no guarantee of functionality or visual formatting for organizations attempting to model more than four plan options within a single output file.

D) PROHIBITED USES: You may not resell, distribute, share, or sub-license the Product (inclusive of the Excel file and the materials it generates) to unauthorized third parties or outside your licensed tier. You may not reverse-engineer, unprotect, or copy the proprietary formulas or code for commercial redistribution or competitive gain.

E) DATA UPDATE GUARANTEE (PURCHASES MADE PRIOR TO RELEASE OF ANNUAL KFF DATA): If the Product is purchased for a given plan year prior to the official annual release of the Kaiser Family Foundation (KFF) Employer Health Benefits Survey data (typically published in October/November), Medicents LLC guarantees delivery of one (1) updated Product file incorporating the newly released benchmark data at no additional charge. Updated files will be delivered automatically to the email address provided at checkout within 14 business days of the public data release. This guarantee applies strictly to data updates within the active licensed plan year and does not constitute a license transfer or free upgrade to subsequent plan years.

3. INFORMATIONAL & EDUCATIONAL USE ONLY

The Product is provided by Medicents LLC for illustrative, educational, and communication purposes only. It is designed to communicate health benefits and employee healthcare costs based entirely on user-provided inputs.

  • No Professional Advice: Medicents LLC does not provide legal, ERISA, actuarial, financial, tax, or medical advice.

  • Data Accuracy: Output accuracy depends entirely on data entered by the user. Official Plan Documents and Summaries of Benefits and Coverage (SBCs) issued by insurance carriers always supersede any materials created by the Product.

4. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Medicents LLC be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Product. This includes, but is not limited to:

  • Errors in manual data entry or misinterpretation of generated results.

  • Discrepancies between information provided in the Product and official insurance carrier determinations.

  • Calculations altered due to modifications, hidden rows, or edited formulas you make within the spreadsheet.

5. REFUND POLICY

A) ALL SALES ARE FINAL: Because the Product is a digital product delivered via download, all sales are final once the Product has been accessed or downloaded.

B) TECHNICAL DEFECTS: Refunds will only be considered if a material technical defect prevents the file from functioning as described, provided you contact info@medicentsllc.com within 14 days of purchase.

C) MERCHANT OF RECORD AUTHORITY: Polar, As the Merchant of Record, reserves the right to issue refunds and handle payment disputes at its sole discretion in accordance with its own consumer protection policies.

6. PRIVACY & DATA SECURITY

The Benefits Blueprint is an Excel file intended to be saved and used locally on your hardware. Medicents LLC does not collect, transmit, store, or process any health plan, employer, or employee data data entered into the file with external servers or artificial intelligence models or products.
